General Terms & Conditions
The present General Conditions of Purchase regulate the use of the web site vindalooeu.com (in forward "the web site") of which Vindaloo S.L. is holder. The use on the part of the client of the services of the shop of Internet of Vindaloo SL presupposes, in any case, the adhesion to the General Conditions of Purchase in the version published by Vindaloo S.L. at the same moment of the order of purchase. Therefore, it is convenient that the client reads these General Conditions before proceeding to make a purchase.
When finalizing the order it is understood that the client has read and accepted the terms and conditions of the company available electronically on the website and in physical establishments of Vindaloo SL.
1. SCOPE OF THE CONTRACT
The present General Conditions of Purchase apply to the sale of all the articles of Vindaloo S.L. across its web page as of the established establishments. Vindaloo S.L. informs that its web site is directed exclusively to a public greater than 18 years. Vindaloo S.L. reserves the right to cancel the account of access of a user if fraudulent, speculative or bad faith acts are detected in the use of this service.
2. PRICE
The applicable prices are those indicated on the website on the date of the order. The prices are detailed in each article and do not include V.A.T. (Value Added Tax). and IGIC in the Canary Islands. The amount of the shipping costs is indicated to the customer in a detailed way at the time of placing the order.
3. PAYMENT
Payment will be made at the end of the purchase process and will be an essential condition for the formalization of the same. Accepted means of payment: Purchases can be paid for by Visa®, Mastercard® credit card as well as by 4B or 4B Maestro debit card (which implies an automatic charge). You can also pay by bank transfer, receipt or cash (if collected in shop). The cash payment cannot be more than 1000 euros as indicated in Law 11/2021 as measures to prevent and combat tax fraud. The client must notify to Vindaloo S.L. any undue or fraudulent charge in the card used for the purchases, by means of email or via telephone, in the minor possible term so that Vindaloo S.L. can realize the opportune managements. The suppliers or issuers of means of payment can adopt measures antifraud that entail the rejection of certain type of operations. Vindaloo S.L. is not responsible for the application of this type of policies of security.
4. DELIVERY
The usual delivery time to Spain is 24-72 hours (working days) provided that the customer places the order online before 13h. For other European destinations, maximum 10 working days from the date of purchase. This period may increase during sales periods, Christmas campaigns or in the event of customs formalities or other circumstances arising from (for information purposes only) geographical distance, weather conditions, wars, strikes, any form of government intervention, non-compliance by our suppliers, etc., as well as any other circumstance attributable to the logistics operator responsible for the delivery of the product. We are not responsible for any delays that may arise for any of the above reasons. Orders will be delivered to the address indicated by the customer in accordance with the following characteristics:
4.1 HOME DELIVERY:
-The customer will pay the transport costs or send their own transport agency at their own expense.
4.2 COLLECTION IN SHOP:
The client can pick up his order in the delegation of Vindaloo S.L. of Madrid. The client will not have to pay expenses of transport in orders with collection in shop.
4.3 INCIDENTS IN THE DELIVERY:
In case of not being able to realize the delivery for absence of the addressee, the agency of transport will leave an indicative note and will try to contact by telephone with the addressee. After two unsuccessful attempts, the customer must contact the transport agency to proceed with the delivery.
5. EXCHANGES AND WITHDRAWAL
There are different procedures for exchanges, returns and cancellations and the characteristics and conditions of each of them are described below.
a) Exchange: an exchange is considered to be a replacement for the same product in the same colour and size due to a defect or fault.
b) Withdrawal: caused by the customer's decision.

Exchanges or cancellations of products that are returned incomplete, damaged, deteriorated, stained or in any state that reasonably indicates that the product has been used, will not be accepted and will be returned to the customer as soon as possible. No exchanges or cancellations are allowed on customised orders in the form of quantities, models, sizes or colours. We do not accept exchanges or cancellations on customised orders in the form of quantities, models, sizes or colours; customised orders are orders ordered specifically for the customer.​
- All products to be exchanged or returned must be properly packaged.
- In the event of withdrawal, you will be responsible only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. In case of withdrawal, Vindaloo S.L. will charge 15% of the amount of the customer's order for the costs incurred and transport costs will be paid by the customer.
-The reimbursement for any case, will be only in the form of a voucher or coupon, usable in the store.
-In case of cancellation of a reservation for an order, Vindaloo will charge 50% of the amount paid for the originated expenses and compensation.

EXCHANGES (due to tare, defect or receipt of an erroneous product) made in the physical shop and online shop.
Conditions: the exchange process must be carried out within 15 calendar days of receiving the order.
- Cost: exchanges are free of charge for the customer.

- In the online shop: contact our Customer Service Department by calling +34 619878211 or by emailing contact@vindaloosl.com and they will indicate the procedure for making the exchange. No exchange will be accepted without your invoice.
RIGHT OF WITHDRAWAL made in physical shop and online shop
- Conditions: you have the right to withdraw from the contract without justification, within 7 calendar days from receipt of the product.
- Cost: In case of withdrawal, Vindaloo S.L. will charge 15% of the amount of the order of the client for the originated expenses and the expenses of the transport will be charged to the client.
Vindaloo S.L. will reimburse the amount of the order in the form of a voucher without expiry date.

6. AVAILABILITY OF PRODUCTS
If there are any incidents in terms of supply or if there are no products in stock, the customer will be informed immediately and will be reimbursed the amount of the product or products out of stock, if payment has been made by credit card. The rest of forms of payment, the refund will be made in the form of voucher without expiry date. Vindaloo S.L. will reimburse the corresponding amount without undue delay and, in any case, before 15 calendar days have elapsed. The data of availability of stock in physical shop that are reflected in our web page are orientative and can vary.
7. MODIFICATION OF THE GENERAL CONDITIONS OF PURCHASE
Vindaloo S.L. reserves the right to modify at any time the present General Conditions of Purchase. No modification will affect the orders that already are in course.
8. FORCE MAJEURE
The company will not be responsible at all in case of impossibility to give service, if this one is due to prolonged interruptions of the electrical supply, lines of telecommunications, social conflicts, strikes, rebellion, explosions, floods, acts and omissions of the Government, and in general all the assumptions of major force or fortuitous case.
9. APPLICABLE LAW AND JURISDICTION
These General Conditions of Use, as well as the use of the Web Site, shall be governed by Spanish law. For the resolution of any dispute, the parties shall submit to the Courts and Tribunals of the registered office of the company. In the event that any provision of these General Conditions of Use should be unenforceable or void under applicable law or as a result of a judicial or administrative decision, such unenforceability or invalidity shall not render these General Conditions of Use unenforceable or void as a whole. In such cases, the company will proceed to modify or replace such provision with one that is valid and enforceable and that, to the extent possible, achieves the objective and intent reflected in the original provision.

Offers and promotions are for online orders only. They are only valid for customers who are up to date with payments.
